General conditions

1. IDENTIFICATION DATA: In compliance with the requirement of information contained in Article 10 of the Spanish Law 34/2002, of July 11, Services of the Information Society and Electronic Commerce, the following information is reflected below: The owner company of yepso.eu (hereinafter, the Website) is YEPSO SOLUTIONS, SL, with address at Lugar de Aveal, 9 - 15638 Vilarmaior, A Coruña, with CIF number: B-70578422, registered in the Mercantile Registry of A Coruña in volume 3.673, folio 160, General section, page C-57.968, entry 1 (hereinafter, YEPSO SOLUTIONS).

   YEPSO SOLUTIONS is a private company, which is not integrated in any case in the institutional structure of the European Union, its agencies or agencies, or other governmental entities or international organizations of a similar nature.

2. USERS: Access and / or use of YEPSO SOLUTIONS’ portals attributes the condition of USER PERSON, who accepts, by accessing and / or using them, the General Conditions of Use here reflected. The Conditions mentioned above will be applicable regardless of the General Conditions of Contract that in their case are mandatory.

   The USERS may be registered or not. The registration on the website is free. However, the products and services of YEPSO SOLUTIONS, unless expressly indicated otherwise, are only available for the USER who acquires them.

   The USER accepts responsibility for all activities carried out with her/his account or password, and she/he agrees not to sell, transfer or assign her/his account or any right granted by the account. YEPSO SOLUTIONS reserves the right to cancel the USER’s account if more than one person accesses the website with the same name. The account of the USER is personal and non-transferable.

   The USER is responsible for maintaining the confidentiality of her/his password and for restricting access so that others cannot access the website with her/his name without the permission of YEPSO SOLUTIONS. The USER who thinks that someone has accessed the website using her/his account should immediately notify YEPSO SOLUTIONS.

   By accepting these Terms of Use, the USER agrees to pay all subscription fees and any other charges incurred in connection with her/his account, USER'S name and password, and current rates. The USER is responsible for all taxes and charges that may be satisfied to access the website through a provider of Internet access or other services. The USER PERSON can notify, at any time, by email, her/his decision to cancel the account.

3. USE OF THE PORTAL: YEPSO SOLUTIONS’ website provides access to a multitude of information, services, programs or data (from now on, "the contents") on the Internet belonging to YEPSO SOLUTIONS or its licensors, to which the USER may access. The USER assumes responsibility for the use of the Web. This responsibility extends to the registration that is necessary to access certain services or contents. In this registry, the USER PERSON will be responsible for providing truthful and lawful information. As a consequence of this registration, the USER PERSON can be provided with a password for which she/he will be responsible, committing herself/himself to make diligent and confidential use of it. The USER undertakes to make appropriate use of the contents and services (such as chat services, discussion forums or newsgroups) that YEPSO SOLUTIONS offers through its website. With an enunciative but not limitative character, the USER commits not to use the service provided by YEPSO SOLUTIONS to (i) engage in illegal activities or contrary to good faith and public order; (ii) disseminate content or propaganda of a racist, xenophobic, pornographic-illegal nature, advocating terrorism or attacking human rights; (iii) cause damage to the physical and logical systems of YEPSO SOLUTIONS, its suppliers or third parties, introduce or spread computer viruses or any other physical or logical systems that are likely to cause the aforementioned damage; (iv) try to access and, where appropriate, use the email accounts of other USERS and modify or manipulate their messages. YEPSO SOLUTIONS reserves the right to withdraw all comments and contributions that violate respect for the dignity of the person, that are discriminatory, xenophobic, racist, pornographic, that attempt against youth or childhood, public order or safety or which, in our opinion, would not be suitable for publication. In any case, YEPSO SOLUTIONS will not be responsible for the opinions expressed by the USERS through the forums, chats, or other participation tools.

4. TRANSACTIONS, PAYMENTS AND ELECTRONIC COMMERCE ON THE WEBSITE.

   The USER of the Web may acquire (which involves the sale of products or services) their participation in training courses, training materials or coaching sessions, among other services.

   Debit or credit card transactions on the Web are managed by third-party payment service providers, such as Addon Payments and PayPal. YEPSO SOLUTIONS relies on these payment service providers which are recognized for making payment transactions with the highest security standards in the market. YEPSO SOLUTIONS will be involved to solve any potential problem that the USER or customer may have regarding the payments. However, YEPSO SOLUTIONS is not responsible for the security and other issues related to the processing of debit, credit or other payment methods. As explained in its Privacy Policy, YEPSO SOLUTIONS and the Web do not store or have access to the confidential data of the USER’s credit or debit card.

5. REIMBURSEMENT POLICY

   The total reimbursement of the price for the acquisition of products and materials, different than the training courses, can be made within 7 calendar days after the purchase and only before the USER started to use them. Once the USER PERSON has begun to use the materials, the refund will only be possible in case of a technical problem that cannot be solved on time. This particular case identifies with a situation in which, due to technical errors, it is not possible to access the content acquired by the USER PERSON for more than 72 hours. The maintenance of the website and other events announced on the website, at least 24 hours before the start of the situation, will not be considered technical problems. The refund, when applicable, will be made within 4 weeks after the approval of the reimbursement request by YEPSO SOLUTIONS.

6. CANCELLATION POLICY FOR FACE-TO-FACE COURSES AND FOR “VIA YEPSO!”.

   If the USER decides to withdraw the reservation that she/he have done to attend one of the sessions:

   • Cancellation up to 10 days before the date: 100% refund.
   • Cancellation up to 5 days before the date: 50% refund.
   • Cancellation up to 3 days before the date: 25% refund.
   • Cancellation within less than 3 days before the date: No refund.

   In order to establish the calculation of the days to proceed with the cancellation of a reservation, the date and time of the start of the activity are taken as reference.

   Aware of possible incidents that may occur, it is possible to cede, without having to face any overcharge, the right of attendance and participation of a person in the face-to-face sessions. That possibility will only be possible notifying to YEPSO SOLUTIONS, by e-mail, at least two days before the celebration of the session.

   YEPSO SOLUTIONS reserves the right to cancel the celebration of a face-to-face course in the following cases:

   1. In case of not reaching the minimum number of reserves. In this case, YEPSO SOLUTIONS undertakes to notify people who have made a reservation, at least, 48 hours before the celebration of the face-to-face session.
   2. In case of supervening circumstances. In this case, YEPSO SOLUTIONS undertakes to notify people who have made a reservation before the holding of the face-to-face course in the shortest time possible.

   If YEPSO SOLUTIONS cancels the holding of a face-to-face training course in the cases as mentioned earlier, the refund will be made within 24/48 hours from the date in which the circumstances are reported.

7. DATA PROTECTION: YEPSO SOLUTIONS complies with the guidelines of the Spanish Organic Law 15/1999 of December 13 about the Protection of Personal Data, Royal Decree 1720/2007 of December 21, which approves the Development Regulation of the Organic Law and other regulations in force at any time. In the same way, YEPSO SOLUTIONS ensures the correct use and process of the USER’s personal data. To accomplish this, YEPSO SOLUTIONS will let the USER know about the existence and acceptance of the particular conditions of the processing of their data in each form for collecting personal data. Also, YEPSO SOLUTIONS will inform the USER about the responsible person of the person in charge, her/his e-mail, the possibility of the USER to exercise her/his rights of access, rectification, cancellation or opposition, the purpose of the process and the data communications to third parties where appropriate. Likewise, YEPSO SOLUTIONS informs that it complies with Law 34/2002 of July 11, on Services of the Information Society and Electronic Commerce and will request the USER's consent to the processing of her/his email for commercial purposes.

8. INTELLECTUAL AND INDUSTRIAL PROPERTY: YEPSO SOLUTIONS by itself or as an assignee, owns all the intellectual and industrial property rights of its web pages, as well as the elements contained in them (for example, images, sound, audio, video, software or texts, trademarks or logos, combinations of colours, structure and design, selection of used materials, computer programs necessary for its operation, access and use, etc.). YEPSO SOLUTIONS or its licensors own all these elements. All rights reserved.

   Under the provisions of articles 8 and 32.1, second paragraph, of the Spanish Law on Intellectual Property, the reproduction, distribution and public communication, including making the products available for another person different than the USER, is expressly prohibited. This prohibition extends to the contents of YEPSO SOLUTIONS’ web page. The USER agrees to respect the Intellectual and Industrial Property rights owned by YEPSO SOLUTIONS. The USER must refrain from deleting, altering, evading or manipulating any protection device or security system that was installed on the pages of YEPSO SOLUTIONS.

   Every product, material, face-to-face or virtual sessions, are property of YEPSO SOLUTIONS unless otherwise indicated. The USER undertakes to respect this right, refraining from attacking it. Otherwise, YEPSO SOLUTIONS may execute all the legal measures established in the legal system to safeguard its rights and interests.

9. LIABILITY DISCLAIMER: YEPSO SOLUTIONS adopts more than all the necessary technological measures to prevent any damages that may be caused by using the internet to access our services. YEPSO SOLUTIONS has implemented high-security measures as believes that the security of our clients is one of our top priorities. However, YEPSO SOLUTIONS cannot assume responsibility, in any case, for any damage that may be caused. For example errors or omissions in the content, lack of availability of the portal or transmission of viruses or malicious programs or harmful content.

   All the material belonging to YEPSO SOLUTIONS are designed as a preparation and practice tool based on EPSO (European Personnel Selection Office) test models. However, the methodology used to design the EPSO tests is confidential and, given that success requires a high and decisive effort on the part of the candidate, YEPSO SOLUTIONS cannot fully guarantee that proper preparation of the materials with the trademark "Yepso!" will give a satisfactory result in the EPSO tests. Although YEPSO SOLUTIONS cannot guarantee the success of any EPSO exam, the USER, when buying the products will be provided with highly exclusive tools and materials to prepare exams for accessing the European public service and which will give an outstanding dimension about the competencies and skills most requested by the European Union.

10. MODIFICATIONS: YEPSO SOLUTIONS reserves the right to make, without prior notice, the modifications it deems appropriate on its website, being able to change, delete or add both the contents and services provided through it and how these appear presented or located on your website.

    The last modification of these conditions were introduced in JULY 2019.

11. USE OF COOKIES: YEPSO SOLUTIONS SL may use cookies to personalize and make it as easy as possible for the USER to navigate through its website. The cookies are associated only with an anonymous USER and her/his computer and do not provide references that allow deducing USER’s personal data. The USER may configure your browser to notify and reject the installation of cookies sent by YEPSO SOLUTIONS, without affecting the ability of the USER to access the Contents. The acceptance of cookies by the USER will be in the form of explicit,unambiguous, informed and verifiable consent. In any case, and at any time,the user may exercise their ARCO rights (access, rectification, deletion,opposition, portability and limitation).

12. If links or hyperlinks to other Internet sites would be available on the Website, YEPSO SOLUTIONS will not exercise any control over their contents. YEPSO SOLUTIONS shall not assume any responsibility for the contents of any link belonging to a third party website, nor guarantee the technical availability, quality, reliability, accuracy, amplitude, veracity, or validity of any material or information contained in the hyperlinks or other Internet sites. Likewise, the inclusion of the external connections will not imply any association, merger or participation between the entities.

    Notwithstanding the preceding, some links may be previously negotiated or agreed upon with the person responsible for the linked content. This situation will not affect in any case the exclusion of liability on the linked content.

13. RIGHT OF EXCLUSION: YEPSO SOLUTIONS reserves the right to deny or withdraw access to its website and/or to the services offered without prior notice, by doing it on its own or by a third party, to those USERS who fail to comply with these General Conditions of Use.

14. GENERALITIES: YEPSO SOLUTIONS will pursue the breach of these conditions as well as any improper use of its website, exercising all civil and criminal actions that may correspond to it by law.

15. AMENDMENT OF THESE CONDITIONS AND DURATION: YEPSO may modify, at any time, the present conditions. The validity of the conditions as mentioned above will be determined based on their exposure and will be in force until they are modified by others duly published.

16. JURISDICTION: The Spanish legislation will rule the relationship between YEPSO SOLUTIONS and the USER, and any dispute will be submitted to the ordinary courts of the Kingdom of Spain, and more specifically, to the courts of the city of A Coruña, which will have exclusive jurisdiction to resolve any dispute that may arise in relation to these Terms of Service, the use of the website and to solve any disagreement between the USER and YEPSO SOLUTIONS.
